Nitish Kumar to go to Rajya Sabha, must resign from MLC post by March 30

The countdown has begun for a major shift in Bihar politics. After being elected to the Rajya Sabha, Chief Minister Nitish Kumar no longer has any constitutional recourse to hold both positions. According to the Indian Constitution and the Representation of the People Act, a person cannot simultaneously serve as a member of both Parliament and a state legislature. It is mandatory to resign from one’s previous position within 14 days of becoming a Member of Parliament.

According to sources, Nitish Kumar must resign from the Bihar Legislative Council (MLC) by March 30, or his Rajya Sabha membership could be affected. His Rajya Sabha term is expected to begin on April 10, before which time he may also step down as Chief Minister.

After Nitish Kumar’s departure, discussions within the NDA regarding the next Chief Minister will intensify. The BJP, JDU, and allies will jointly decide on a new leader. Political experts believe that Nitish Kumar’s choice will determine the next Chief Minister. The picture is expected to become clearer by the second week of April.

Nitish Kumar’s political journey has been quite interesting. “Sushasan Babu,” who has been at the center of Bihar politics for the past 20 years, has served as Chief Minister nine times. He hasn’t contested any assembly elections in the past decade, yet he has maintained power. Now, when the reins of Bihar pass to someone else, it will mark the end of an era.
