US Warns EB-1 Green Cards for Indians May Temporarily Shut Down Ahead of Fiscal Year-End

WASHINGTON: The United States government has warned that employment-based first-preference (EB-1) green cards for Indian nationals could face an immediate temporary shutdown due to unprecedented demand exhausting annual visa limits. In its September Visa Bulletin, the US Department of State cautioned that rapid visa number consumption by applicants chargeable to India could deplete the statutorily mandated annual per-country ceiling before the fiscal year concludes on September 30.

The State Department confirmed that if the annual allocation for India in the EB-1 category is exhausted, the preference tier will be designated as “unavailable” (U) until the commencement of the new fiscal year, when fresh visa numbers are released. In the September bulletin, the EB-1 Final Action Date for India is set at October 15, 2022, restricting final green card approvals strictly to applicants with priority dates predating that cutoff.

The warning creates severe concerns for high-skilled Indian professionals, multinational corporate executives, and advanced researchers who depend on the EB-1 classification as the most direct route to permanent residency. With EB-2 already marked “unavailable” for India and the EB-3 waiting list facing an extensive backlog of over 12 years, a potential pause in EB-1 approvals introduces significant procedural delays for Indian applicants navigating the US immigration pipeline.
