The Constitutional Bench of the Supreme Court gave an important decision regarding Delhi today. While this decision is being seen as a setback for the Central Government and the Lieutenant Governor on one hand, on the other hand this decision has brought relief for the Delhi Government. The bottom line of the Supreme Court’s decision is that the real boss of Delhi is the Chief Minister of Delhi. The Supreme Court has advised the Lieutenant Governor to follow the advice of the elected government of Delhi. Things that come in the hands of the Delhi government in the decision
The officers will be posted by the elected government of Delhi.
Delhi government will also have the right of transfer posting of officers.
Now the Lieutenant Governor will not be able to do his mind in the deployment and transfer posting of officers.
The Lieutenant Governor cannot act arbitrarily, he has to follow the advice of the Delhi government.
Now it will not be mandatory for the elected government to take consent from the Lieutenant Governor for its every decision.
The Lieutenant Governor will not have extensive administrative rights related to the issues of the state.
